Source of Birth Date: JAMES K. WEST was born June 24, 1833, on the place where he now resides, in Christian County, Ky.; his father, Jesse West, was born here in 1798, and also died on this place in 1843. He was the son of Charles West, who was born in South [sic] Carolina, and died in Christian County. Subject's mother, Martha, daughter of Jacob Pruitt, was born in 1803, in Illinois, and died here in 1880. The children of the family consist of Henson R., John M., Amos S., William E., Susan C., Sally R. (Cooper), Charles P., Eliza S., Francis M. and James K. (twins), Jesse W., Harmon N. and Henry H. James K. West has never married; he is a farmer, owning 245 acres of land of a fair quality, on which he cultivates wheat, corn, tobacco and clover. The place on which he resides was one among the earliest settled in the county. Mr. West is a member of the Blue Lodge, A. F. & A. M., and a member of the Christian Church. I, Thomas West, of the county of Chatham, farmer, do hereby make my last will and testament, revolking all others heretofore made.


In the first place, I appoint Jesse West, my second son, and Joseph Meacham, my son in law, from the reliance I have in their integrity my executors to execute and carry into effect this my will.


Secondly, I leave and bequeath to my said executors Jesse and Joseph all my Estate real and personal forever, liable to the trust now declared in this my will, it being my principal object and desire to provide for my wife, should she outlive me, during her life comfortably and that at her death all my Estate should be equally divided among my 12 children or the representatives of such that may be deceased at my death.


Therefore appoint my said executors, trustees to divide my estate as follows to wit: that my whole Estate should be appropriated so as to afford a comfortable support to my wife during her life, and at her death either by sale division in lots or otherwise at the discretion of my said Executors to be divided into twelve equal parts, that my said executors shall deliver to such of my sons their shares and shall so settle on each of my daughters and their lawful heirs their respective shares in such manner so that their respective husbands shall have controll over said distributive shares and that it shall not be used for debts or contracts unless he gives sufficient security for the same to be appropriated to the support of my said daughters and their issue, agreeable to the true intent and measure of this my will before the said division should be so made I trust my said Executors after paying all my lawful debts and funeral expenses do retain (one hundred?) fifty dollars as a small consideration for their services and trouble.


And I declare this my last will being on my (perfect time?). this 28th. day of February 1807 as witnessed my hand and seal in presence of us being first called on the testator to witness the same.

Know all men by these presents that I Thomas West of the County of Chatham in the State of North Carolina, farmer, having an intention of removing to the Western Country and being possessed of land in the said County in fee simple and also of diverse Chattel property which I cannot now satisfactorily dispose of I therefore hereby empower my truly and well beloved son Jesse West of said County and State my true and lawful attorney for me and in my name to dispose of for my use and benefit all my property real and personal which I shall have undisposed of when I remove and particularly my land on dry Creek supposed to contain about 225 acres adjoining Mrs. Lutterloh's and Edward Jones'z which land I bought of Zachariah Martin and also 100 acres of land adjoining other lands of Edward Jones which I purchased from the state agreeable to my grant for the same. And I hereby empower my said attorney to dispose of the same and to give bills of sale, assurances, covenants and a deed or deeds in fee simple in my name or such other conveyance or conveyances as may be requisite to pass my interest in the same to the purchaser thereof with a special warranty and covenant of warranty for a good and sufficient title to the same against all persons, but the heirs of the Earl of Granville - And I hereby acknowledge all the acts and deeds of my attorney aforesaid which he shall or may lawfully do in the promises to be my act and binding on me and my heirs my executor and adm.

Stites be appointed a Commissioner to convey to John West all the right title & interest of the heirs of Thomas West by quit claim deed in & to the said tract of land in the bill named on which Tho. West died & the same conveyed by Edmund Taylor to said Thos. West by deed bearing date 19th. June 1819.   Each party from this time out to pay their own cost & all fees coming agt. John West from the Christian Clks. Office not paid by John West on or before the 30 July 1836 to be paid by defts. & the bill dismissed without prejudice as to John West's claim in & to the personal estate & slaves of his brother Tho. 9. Thomas West, Sr. (Before 1718 – 1808) [Lucy Hall ?]

Marriage Record: From an e-mail message I sent to Ben West 25 Mar 2001:


I did realize my lack of zeroing in on a more accurate estimate of birth year for Thomas West, Jr. (1738 or earlier) and until just a few days ago, I had not thought too much about the 1760 date of John Hall's will. That fact makes the likelihood of Lucy being Thomas West, Jr's wife a lot lower (assuming the Lucy that is mentioned in the land transaction as wife of Thomas West - is the Lucy West mentioned in John Hall's Will)!!!

Transcribed from the Bute County Record Book 1 (Source of this transcription is a published book: Warren Co., NC Records (Vol. I) Abstracted Records of Colonial Bute Co., NC 1764-1779 and Bute Co. Marriages, compiled by Mary Hinton (Duke) Kerr, The Reprint Company, Publishers, Spartanburg, SC, 1983 p. 6) Book 1, p. 42 Will of John Hall of Southampton Co.(VA?).   Dated 27 July 1760.   Wife Mary Hall.   Daughters: Lucy WEST, Jhan (Jane?) A Thomas West and wife Lucy sold some lands in Orange or Chatham County some years later (I think the deed has already been submitted to this site).   It has been argued that this Lucy is the Lucy that is in the John Hall will.   It has further been said that this Lucy is the wife of Thomas West, Jr. (b. 1738 or earlier).   I suspect, however, that this Lucy in the will in 1760 is too old for Thomas West, Jr.   She would be much more likely to be the wife of Thomas West, Sr.

From the Earl of Granville, by his agent Thomas Child, "Thomas West, planter of Granville Co." received a land grant of 386 acres, dated 29 Jul 1761. This grant was in Granville Co. on "Cyprus Swamp," adjoining Brinkley and Simmons (DB A, p. 316). Bute County was formed in 1764 from Granville Co. and included this land. "Thomas West of Orange Co." sold this land on 1 Dec 1766 to Samuel Eley of Bute Co., "386 acres in Bute Co. on the Cypress Swamp, a Lord Granville Grant of 29 Jul 1761" (DB B-1, p. 347). These deeds show that Thomas West moved from land that was formerly in Edgecombe Co., NC on Bear Swamp to land that was on Cypress Swamp (formerly in Granville, then Bute, and today in Warren Co., NC) and then into Orange Co. by 1766 (a distance of perhaps 70 miles from Cypress Swamp).

Indenture 9 Aug 1774 between Thomas West and Lucey his wife of Chatham first part Charles Stuart of same county. Witnessed that said Thomas West and lucy his wife for 53 pounds, 6 shillings and 8 pence lying in the county aforesaid on the branches of Robertsons Creek beginning at a post oak & hicory on the path side leading from the meeting house to David Banks thence south west wise on the ___?_____ line to a Black Jack thence nearly north on a line of marked trees to hicory thence coming along a line of Marked Trees nearly east to the creek then corner'g on the south side of the said Creek on an Elmm thence with the said Creek to a willow Oak on the North north side of the said creek near the mouth of Sal. Mashes Spring branch from thence nearly east course along a line of marked trees to the old line from thence along said line to the first station containing by estimation 190 acres being part of a survey taken up by Samuel Mash.

The last Will and Testament of Thomas West Sen’r. was duly proved in open Court by the Oaths of Robert Richerson and Elizabeth Richerson witness thereto and ordered to be Record[ed]. Whereupon Administration of the Estate of the said Thomas West sen’r is granted to Ignatious West with the Will annexed?, he having entered into Bond in the sum of One hundred and Twenty pounds with Robert Richerson and Obed Powell his Securities and was duly qualified.
